Fail to comply with solid white line.

I just received NIP for this . What is the potential outcome for me if found guilty?
Alleged offence took place 6 months ago , so fist of all surprised how long it took for me to be sent the NIP.

I overtook a two slow cars indeed, but in fairness, the markers on the line were rather faint.

Should I plead guilty?

First post and you're asking this?

3 Points normally.

Did the same thing 8 years ago, overtook a slow moving caravan, I didnt see the police car behind me, Got pulled and got a fine and 3 points, No point fighting it as you could potentially get extra points and pay court costs,

Done this where I tried to be clever and take a speeding offence to court, I tried to use all the excuses about the weather conditions being wet and lazer not working properly etc etc but didnt work and ended up costing me court cost/fine and a extra point on my license:(

Just learn from it, pay it and take the points and move on!!:thumb:

Is there a date stamp in the front of the envelope? If more than 14 days ago, then you MIGHT have a case of it being thrown out, regardless...

Steve001 17 May 2017 08:25 PM

You are permitted to straddle or cross a continuous solid white line to enter a side road or property, to manoeuvre round a stationary vehicle blocking your side of the road, to overtake a cyclists, horse or a road works vehicle moving at 10 mph (16 km/h) or less.

Taken from here, were the other cars going less than 100mph?

The first Nip must be served Iin the first 14 days after the alleged offence. Subsequent nips don't . you will need to explain why you didn't get the first Nip. If you changed address at the time of offence and informed the dvla correctly then there may be an argument why the first Nip was not served in the correct the manner. If you just ignored it and now have another, plead guilty and take your punishment.

joz8968 17 May 2017 11:23 PM

Sorry, my bad.

So, unless he has failed to respond to/mislaid a previous NIP (one which presumably would have been sent out within 14 days of the offence), then things are looking good for the OP.

I guess he needs to ring the relevant county police force to find out proof/when/if they sent the first one... Then go from there...

You just admitted that you overtook 2 slow cars. So you're in the wrong - yes? Unless the cars were doing less than 10mph take the points and learn how to drive carefully and respectfully of other drivers.

Says he's JUST received NIP ? !

Tidgy 18 May 2017 10:45 AM

6 months and no NIP is game over for them.

A useful site regarding NIPs:

I had the same 5 years ago, was a £60 fine TS20 code and 3 points back then passing someone doing 20 in a 60 and only clipping the line when I came back in. Didn't even go over it when I started the move. Harsh I thought.

May get invited onto a course. They have courses for everything these days.

Ian E 20 May 2017 03:22 PM

Did you get pulled over by the Police at the time of the Offence? If so, that is a verbal NIP and they have up to 6 months to send you something through the post.

dark_angel 21 May 2017 10:48 AM

I was under the impression that Notice of Intended Prosecution needed to be "served" to the person not posted - a long while ago (when I was an angry young man - now just an angry old man lol) I got involved with a road rage incident (not my doing just defending a young inexperienced lady when an arse of a taxi driver got in her face) and a ex copper got the wrong end of the stick and reported me as the aggressive party. Anyway the magistrate said as the NIP wasn't given to me personally - it was a technicality and therefore no case to answer (they couldn't trace the young girl dispite having the vehicle index !!)

The NIP procedure may have changed now though.

I think the OP was having a laugh. He's not responded to anything since posting and it was his first post.

Its a motoring offence, not a criminal offence. Doesnt go on a criminal record.

Semantics. The offence goes on the PNC and if you kill someone in a car it is criminal offence.

Not the same at all. Even when you choose to be exteme to prove a point Death by dangerous driving carries no where near the sentence of muder or manslaughter.

alcazar 24 May 2017 09:36 AM

Is this still running? The OP was obviously on a wind-up. Let it go.
