Girlfriend has written a letter to Elephant, at the time in question we were round her folks place (both us and them live in Kent), and also visited Bluewater, but we wouldnt have any definitive proof of this expect for families/our word on it (no CCTV etc)

Could this be a problem? I mean, how do we prove we werent anywhere near Scotland, but actually the other side of the country entirely, and what resposibility does my girlfriend have, does she have to prove she wasnt there, or do they have to prove she was?

Also, if they push this, would it be a court in Scotland that any appeals would take place?

I work in Scotland as an insurance assessor.

I've come across this before ( although I hasten to add its not just a Scottish problem !).

Almost certainly a clerical error as either :

A) The Third Party Insurance company mistyped the reg no
B) The Third Party motorist took down the wrong reg

Note with A) they can trace the details of any insured car from their computer through the CUE system, so they may have been given a wrong reg no and obtained your address through that reg no !

Either way, call your insurer, specify where you and your car were on the day in question and insist that they immediately write to the T/P insurers to ask for the type of vehicle their motorist says was involved in the accident
and any other evidence of your invovement (they won't have it).

Make sure your insurers insist on a letter from the T/P insuers confirming you and your vehicle were not involved, to put your mind at rest.
