Is the limiter in the ECU? If so it maybe a speedo error. Have you ever compared your speedo against a satnav?

As said check with satnav, my bros was only doing 65mph sat said 70mph. This will increase as speed increasers.

Makes no difference chaps, the limiter is set by the speed indication given by the wheel speed sensors.
i.e once the car sees 155mph by it's own measurement (i.e the wheeel speed) it will then impliment the limit.
However....
some cars left the factory without the limiter set for reasons such as.....
press car going to a track for testing
previous driver has a racing licence, therefore bmw are legally allowed to switch the limiter off.
Or it has had the limiter mapped out by someone.

Ive seen a few cars allegedley limited to 155mph,but clock well over. May have been mapped out or over ridden. I remember Top Gear had a M5 up to 170mph once which is limited to 155mph.

Afaik the speed limiter words as a pre set rev limit in certain gears. Years ago they would only set the limit on 6th gear, so if 5th had the legs then you could get over the 155mph limit quite easily.

I don't think the limiter works from wheel speed, or at least certainly the older cars don't. This means that your speedo can over read your true speed, just so long as you don't hit the rev limit. Fitting larger wheels also helps you get over the limit on these vehicles.

The speedometer on most cars over-read by about 3 to 5%. Some sat navs also factor in the same error margin (for liability reasons), so aren't to rely on either.

Therefore 155mph can = upto 162mph

My Golf is the same. Confimred by VAG-COM which will display the actual measured speed, and its always lower than what is indicated on the speedometer...being a percentage error, the faster I go the, bigger the difference. 100mph is actually a tad above 95mph.

Many R32 owners have reported seeing a 160mph indicated top speed on a standard car; yet officially its 155mph.

Same with our BMW e39 530; I've seen it read off the clock (over 155), just like this one: http://www.youtube.com/watch?v=sHJSmV6oork Its clearly off the clock here, but the last line on the dial is 250km/h (155mph) and the needle is clearly above this.

There was a rumour that being in 5th gear in an E46 M3 would defeat the speed limiter.

Maybe its the same for the E90 etc.

But I dont think this is true. More likely to be speedo error.

Several people have "beaten" the limiter on both 335is and 335ds. Some have been a fair bit over 160.

This is true, my old man got considerably more than 155 out of his old E46 M3 by staying in 5th.
Regards the newer models, his M5 had a speed limiter on it, but didn't kick in till 170mph on the clock (160.8 on Racelogic VBox). This was at this year's MLR 30-130mph day on a none timed run (practise run).
You can see it just stop when at 170mph, which was gutting, as we had half the runway and nearly 2 gears left..

The M5 also did it when they compared the estate E63 AMG and M5 on the runway at Manchester Airport.
