Default Block Exemption and Servicing

Hi all,

I have recently been told that amongst the new Block Exemption rules, there is one that states, broadly speaking, that manufacturers cannot invalidate a manufacturers warranty if a car has been serviced by a non-franchised independant.

There is some sort of clause that all parts fitted must be of equal, or better, quality to that fitted on the production line. But that's no problem, most service parts on new cars are patent parts anyway.

Has anyone tested this ? Would be nice if I could tell the £95 per hour labour charging franchised dealers where to stick their labour charges

There was a good thread about this not long ago but I can't find it. Basically there is a clause in the Block Exemption ruling that came in of October 2003 that left it up to each member state of the EU to decide if this practise of warranty/service restriction should be allowed. Think it's "always" been the case hasn't it? You can get it serviced wherever you like as long as the recommended service criteria are met and original or approved 3rd party parts are used.
Not sure how it'd affect the "perceived" fsh though? Even though it'd have it, people may wonder why you didn't get it done at a franchised stealer.
