Oldster - I was complaining about the fact that I had been given the promotion on a trial basis and then after 5 months it was made permanent, and I've now been doing it for over a year yet they haven't stumped up the extra cash they promised me. They are now saying that my position has never been officially confirmed as permanent therefore they aren't paying me the extra cash. You said that they can't do that because of the length of time I've been doing the job, and quoted something like "assumed position" or " assumption of duty".

Does that ring any bells??

Righty, when you say you were given the promotion on a trial basis and then after 5 months it was made permanent, was this confimed in writing? was there any formal interview process?

I don't have anything in writing after the initial letter from over a year ago stating the terms of the promotion (ie timescales and salary). After the trial period ended I had a meeting with the boss and he told me that it was permanent but this was only verbal. I have been chasing up the salary increase ever since!

lol - I dunno how I've managed to keep my temper on a couple of occasions and resist the urge to drag him outside and vent my frustrations in the time-honoured tradition of a bout of fisticuffs I've had to walk out to cool off a couple of times. Usually to the pub for a few beers!

Right I think you may have a case, I seem to remember our original conversation and I thought they had been paying you the increased salary and that had been reduced, in that case "custom and practice" could have applied. In your case the fact that you have the letter from a year ago setting out the terms and conditions of your 'trail' constitutes a 'contract' and presumably you have met these terms and have continued in this position for over a year, you should be able to contest their view in terms of 'breach of contract' I have taken advise from our senior h/r manager. Are you a member of any trade union? You could always try ACAS advice line on 08457474747

If the postition was offered in writing for a trial period of 5 months, and the new additional duties continued on beyond the trial period, and are continuing to this day, then i would strongly argue the fact that the postition became permanant, unless of course they informed you.

From the element of law i studied (brief), to my knowledge a verbal contract is as good as a written contract.

Happy New Year Steven!!!

Well that's basically where I am at the moment. I was trying to resolve the situation through informal channels but it was going nowhere so after a year I raised an official Grievance to make it formal and get it sorted. I had a meeting with my immediate boss who took it personally and suddenly decided that he didn't think I was doing the job properly, yet had never once raised any concerns over my performance in the role. That meeting went nowhere so I escalated it to one of the Directors, who said that as I had never received official notification in writing that the position had been made permanent, then I was still "on trial". He refused to take the original letter into account, despite the fact that they actually offered me a payrise a few months ago but I rejected it on the grounds that it wasn't the same as the offer I'd had in writing and signed up to. Basically they're doing a big u-turn and this is the only way they can see of getting out of paying me what they owe me. I've spoken to an HR Company who said that they don't have a leg to stand on - however the only way I can get it sorted out is to resign and take them to tribunal on "constructive dismissal". Seems a bit drastic to me!!!!! And only something I would consider once I've got another job lined up.

Mr D - a couple of quickies whilst we have your attention.....

When my car gets mapped by Andy F on Saturday, will that be the end of the pops, bangs and flames?

Will it make a difference to the map which dump valve I have on? ie if I have it mapped with the vta on and then change back to a recirc at some point in the future, will there be any adverse effects?

Also, for the map should I keep the K&N panel filter and std airbox on, or put the Blitz induction kit back on? I realise that changing these in the future will affect the map therefore which would be best to have on?

Oh and whilst I'm at it, do you have any Samco hoses for turbo/intercooler that would fit mine that you want rid of prior to the weekend??? I'm guessing the std hoses will be on or around their limit after the map??

Thinking out aloud, i may have one hose that will do the turbo to intercooler part, but your better off ordering the turbo kit for your year of car.
