I don't understand though, you can only receive a caution/reprimand if you admit to the offence yourself and sign a form at the station to accept that you were responsible for it. If you didn't do it, then why sign something to say you did? Your mates would have backed you up presumably.

The section 59 - what was written on the form, was it that they had seen it being driven, or a member of the public had reported it being driven? Again, I think you sign this form to accept this version of events and accept that a 59 is issued against you or the quad. Otherwise, you can contest it.

What I don't understand is if people are saying police and are lazy, then surly the lazy thing to do would be to just walk past it.

Each officer will have a different tolerance level - however, the offence of S5 POA has to prove the fact that it will cause harassment, alarm or distress to another - and the officer does not count as the 'other person' as the courts have stated that the police should expect abuse and not be harassed by it (different thread/subject there altogether!)

So, the officer that you have seen letting the 'known criminal' get away with swearing could be the kind of person that will allow all people to swear in a similar manner to a certain point. So he will be treating them equal. Unless of course you have seen the officer deal with a number of similar incidents in different ways to different people.

There is no offence of 'swearing' the nearest offence is S5 POA, but it has to be proven that it will have caused harassment, alarm, distress. Therefore each incident will have to be taken on its own merits. So, using colourful language whilst in the town on a Saturday night may not contravene S5 as compared to doing the same outside a school at 0930 on Monday morning.
