I disagree. Do not accept the car, give them the choice of a full refund or court. They'll likely jump on the refund oportunity.

Agreed, when i threatened them with trading standards and posted links to my thread about them and so many people seen it and shared it on facebook etc.

they were right on the phone with cash waiting for me.

soon as it impacts their business they have to act on it.

Maybe this might allow the 'Director' thread to be reopened again?

(Not Yoda banging Luke, the OP's problem)

Yoda banging Luke is wrong. Where is Vadar when you need him?

I always ask to take a car on a 20 mile run at least before I purchase. That way you a get a proper feel of everything and noticeable problems can be negotiated in the price.

But I was looking at it from possibly the courts view in saying that the car was rectified of all the problems etc

Personally I would accept the cash and tell the place to take a short drive off a steep cliff as I wouldn't want to have anything else to do with them

That's if a problem is reported after 6 months.

Mine was 2 days after purchase.

Director thread? Interesting.

Does it involve Cheshire performance disappointing customers?

They've said it ready to collect and is 100% now. Wouldn't I just want to draw a line under all this?

Well yes, like I've tried to draw a line under it for about 6 weeks now. I've asked for a refund, for an exchange for an sti with similar spec, I even chose 3 out of current stock and was stupidly willing to add cash just to put an end to it all.

I've completely lost faith after 15 weeks of wasted time. They could of rebuilt a Boeing 747 in that time.

The director thread was just a failed attempt to justify their actions and it didn't go well for them and was removed....was quite a read. The director thread was mostly directed at me because they sold me a problematic car and I made it clear to anyone thinking about going see any of their cars to not bother and your situation is a perfect example why not to go.
If you get the option to get your money back, just do it and run

Why was the thread deleted?
Seems a shame that on a forum dedicated for subaru enthusiasts that threads like this get deleted, surely it is in our best interests to know about places like these.

From what I remember, the 'Director' contacted the Moderators and starting quoting 'libel this libel that' (possibly) - there wasn't anything of the sort in the thread really, but he got scared after attempting to explain why he gave poor service in a particular transaction/instance... They all the other 'instances' came to light, and he ran away crying to his mother and the mods because he didn't like people questioning him or being honest in public about their bad experiences with him - he basically couldnt come up with enough BS for all the ropey cars he had been selling.

SN obviously dosen't have a legal team so at times its probably safer just to pull the thread just in case (or if they are paid up sponsor)...I got told off for talking about the C word , so don't mention the C word.

Something isn't right, so let the courts settle it
They emailed you this morning to say the car is ready and before you went down and had a look to see if all was well or more of the same you came on to a car forum THAT THEY COME ON and said you are taking them to court.

Why not keep your mouth shut for ONE day and see how the car is?

If you take them to court all they will do is stand there and say the car was done and we sent him a email to come pick it up and he refused and we are here today in court, you will get laughed out of court.

At this point in the eyes of the law you have a perfectly usable car sat there and C performance have made good a problem. That may not be how you see it but until you go and see the car for all you know it's tip top condition and until you know otherwise you have to act accordingly.

Keep my mouth shut for one day? It's been 15 weeks and I've kept it to myself for that time. Plus as you can see from my previous comments I knew little of these old threads and previous issues other than a few people asking about them with poor replys. I certainly didn't know they come on here.

I told them I'm involving the court's yesterday and already applied for the papers. The following day they say the car is ready, again....

I've waited 15 weeks you absolute mug, I've no faith in the botch job of a car, they've said they struggled to find the problem in all that time, a problem that involves my breaking system, diff and gearbox. Of which they have failed to repair before! I have 2 young children and I'm concerned for their wellbeing in that car after all this.

Citizens advice have told me I'm well within my rights as have 1000 others. Plus I want compensation, and I'm more than likely to get it.

Ridiculous situation... and a real shame that they buy a LOT of genuine enthusiast cars which I will now see in a slightly suspicious light.

Cheers,

What's genuinely disappointing is that after all this hassle and wasted expense I just want my money back. Nothing more nothing less. They made a profit on the px I gave, it sold within 2 weeks and even they said they advertised it too low. Nearly 1k more than they gave me for it.

The repairs will of cost them, ok, that's tough and the business they are in.

What's more is while on a group on fb I spoke to the guy they bought the car off. They gave him 6.5k , they sold it me for 8.5k.

With my px there up say 2.5k, I doubt the repairs have cost that. So they haven't lost anything and STILL won't refund me my money. 15 weeks of hassle and a so called top Subaru trader with a good turnover (judging on the amount of motors they sell on) can't even simply refund my money.

It's laughable.

I don't get it either,if they've aparantly fixed it and they give you your money back they will be able to sell it on and it will be a sorted car. My guess is they haven't sorted it.

Exactly pal.

It's taken a failed attempt and 15 weeks of them saying their finding it hard to diagnose.

I'm not having my kids in it again and all I want is a refund. This is just a situation any trader can end up with when buying so many cars. A few are going to be problematic and they should deal with it at their expense, not at mine.

Sorry sir were struggling to repair the vehicle please accept a full refund or exchange and our apologies.

They've lost nothing, can repair the car and sell on. Most importantly they have gained respect as a reputable trader.

Is it that difficult to comprehend?

Well what do you know. Yet another director change TODAY at Cheshire performance according to Companies House. Anyone know the purpose of this? Is this to prevent legal action, does the small claims court have to be directed at a named individual.

This is the third time in the last year that Mr Asim Ali Shad has terminated his director position!!

Alarm bells ringing very loudly with this company!

Oldest trick in the book. If any action is taken they'll argue that the company is under new management.
