Nope, we wanted to go to small claims, can't remember why we didn't. The traders went into criminal receivership half way through our case which threw a spanner in the works.

We did win though and were awarded £12400, our case changed the game for cars sold not fit for purpose.

And there's me thinking they had changed as it had been quiet regarding those 'muppets' at CP. Once ****e always ****e....good luck and I hope it all gets sorted.
Still can't understand why people go there

But will I ever get the car back, that's the question. They just keep fobbing me off day after day.

I told them bollocks earlier, it was the final straw for me. Citizens advice say all I can do now is go to small claims court as the defect needs to be rectified in a 'reasonable' amount of time. 6 weeks then a further 9 weeks is probably more than reason, so haven't a leg to stand on.

Once the judge sees I've tried (I've always made contact through emails for printable dated evidence) and my rejection letter was Erm rejected. I'm more than likely going to win the case and have costs payed plus compensation. That's the words of citizens advice.

What a ball ache. They're just interested in selling the next car rather than current/past clientele.

Trying to keep things formal for evidence too.

Truth is I struggle keeping my cool at the best of times, it won't do any good.

I've bought this car:

http://www.cheshireperformance.co.uk/our-range/02-02-one-owner-immaculate-sti-prodrive-with-pff7-absolutely-stunning-330-bhp-genuine-52k-miles-fsh.htm

Turned out to have rotten subframes and a 6" hole in each sill.

Not impressed.

Another thread about Cheshire Performance.

Sorry to read this op but I'd get the small claims paperwork filled out. They've p1ssed you around for 6 months, what makes you think they are going to change now?

The thing is,the director posted that long winded thread trying to defend his company and got ripped apart by everyone, then asked a mod to remove the thread (which was done),you'd think it would have given them a kick up the backside to change their ways. Nope....still the same.

By way of contrast.. Torque GT in Devon sold a very nice looking Hawk STi to a customer from Wales. After a while the engine sadly failed due to a broken oil pick up pipe. Unfortunately the new owner ignored the warning light and just drove it until it siezed solid!
Torque GT offered the owner a full refund on the spot and bought the car back. They delivered it to me for a full forged build and they now have it back running it in ready to move on to a new owner.
That's the way to do it!

There's a big difference between people that run a business for love, compared to those that run it for money.
Very few people go in to business as an altruistic pursuit. The difference is how they conduct themselves in the process of running the business, especially when things go wrong.

Look at their history on Companies House (free app by the way), two people appear to flik flak as the company director. Something dodgy going on there!

The director, Ali, seems pretty sound always shook my hand and promised to rectify any problems.

Ultimately it's his decisions that have got me into this mess so obviously that was all just for show.

The more I read the more I realize They've mugged me off. Just hope others avoid them at all costs

Oh yeah the old "firm handshake and look you in the eye" trick, means **** all these days unfortunately, it's now firmly in the realm of " the cheques in the post"

Sorry to hear about all this. Please please please, do not give them anymore money. Small claims court is now your only course of action.

And next time, do a little internet search on the dealer before parting with your hard earned.

These little ******* need shooting!

Don't worry, I didn't pay that. I also didn't notice that my car (despite being bought nearly 3 months ago) is still being advertised on their site, autotrader and Pistonheads, at more than my friend paid for it.

(Run down of my scenario, friend bought scoob, changed his mind, CP offered him £6k to buy it back, friend sold it me instead, I discover rot)

I think after all that I probably would go to court.
You have proof of all of the emails sent etc.

It's going to court now bud, I've exhausted all other routes.

They mailed me this morning saying they don't want it going to court and the cars ready. Well I was told this last week, then ignored, then this week I was due to collect and they made up a feeble excuse on the day.

Something isn't right, so let the courts settle it

If your car is ready then get them to deliver it to you. Take it for a proper test drive when it arrives and if its still knackered then tell them you don't want it and you will see them in court
