Cutting a long story short, i avoided hitting someone on sat in the noble by locking/skidding to a halt within 1 Ft after they pulled out in front of me. Now i am in talks with them as it was a company car with there details plastered all over it. The trouble being is i now have two flat spotted tyres. Was relatively low speed 30/35 in a 40. But can i legally claim the tyres or should i just persue the fact a female was driving the car and the said company think it should be a male.

Steve,

Just a thought. If the other insurance company refuses to pay out but you've registered the claim with yours, will it not be shown as a non-settled claim? Thereby forcing your insurance premium up?

TBH you would not be able to claim for say extra fuel if a road was closed due to an accident and you had to go the long way home annoying and frustrating but necessary in the circumstances so why would you be able to claim for tyres if you had to lock up to avoid an accident.
I would just be grateful you did manage to stop and didnt total your car. Id see it as a lucky escape rather than a reason to claim tyres.
insurance companies take the mikey as it is, due to stupid claims for minor things or false whiplash etc
Personaly i just think that this kind of claim fuels the cost of insurance.
Id also be embarrassed to claim for tyres in this situation.

No accident no claim really.

not intending on claiming via insurance TBH but from the said person/company. Why should i have to fork out the £300 for the two front tyres on the noble when someone else was totally careless THEN laughed at us.

 Steve, I think you may have your answer!

But if they know you, then a bit odd to deny that the incident took place?

Ive known people get payouts from Bus companies where they have damaged alloys when a Bus has pulled out on them etc so why shouldnt you get the cost of the tyres back? makes you wonder if it had been better to just nurf the car and not stop completely,
But as said before why deny the incident?
