This problem sprung up tonight, talking amongst friends, as you do. (Not my problem BTW)

Supplier hired customer something valuable (in the region of £25k)

Customer then has said item stolen, and was then (eventually) paid out by his insurance company (Insurance was hirer's responsibility)

Hirer then asks for money, to which customer says he has spent it Customer 2 weeks later then winds his company up

So I presume this is fraud / theft / deception / all of the above ?

What should his next step be ? Police before solicitors / soilicitors and then police ?

Any advice greatly appreciated (pm me if you want)

I'm unsure how the customer got insurance in the first place? Insurance companies generally won't allow you to take out cover on something which isn't your's in the first place - eg: I couldn't take out 3PFT insurance on your car...

I'd start at the insurance company personally. It wasn't Y's goods to insure - it was X's.

 

If we're talking plant hire, it's usual that the person hiring the kit is responsible for insuring it, and the hire company will often ask for proof that insurance is in place to cover hired items.

 

But if X = Y and Z to the power of 2 = X - P ....

This is totally different to a motor policy.
Under a Contractors All Risk Policy you can have a section that covers hired in plant.
The payment to the insured is the usual procedure so he would be wasting his time approaching the insurers.

Insured/person who hired the goods - is in breach of contract with the supplier so the only way the supplier can recover his loss is through the courts.
