Posted this here as I think it _could_ be relevant to another thread on this Board.

Is anyone aware of any sort of time limit after which you cannot cancel a credit card payment ??

Situation could be where you have ordered something mail order and the company keeps telling you its delayed until - hey presto - you have lost your money and cant get it back, and the company has disappeared.

As far as I know, you have 6 months to dispute and item.

However, I would report the problem now, so if it does go over the 6 months you should be covered.

Mmmmm, this is not the Scoobynet company is it? I ordered their Scoobynews CD-ROM over a year ago and have still not received it. I'm beging to think that it does not exsit. Do you think I have any chance of getting my money back from the CC company....

All chargebacks have to be instigated within 180 days. That's a rule for both Visa and Mastercard. Beyond that, you are outside of their regulations and would need to look into other methods, such as small claims courts, etc, if appropriate.

So I guess that if said ordered item does not turn up on the right day this week (3rd promised delivery date) then I will be onto the credit card company.

And once you do instigate a charge-back, the Visa / MC rules allow plenty of time. I queried a charge back in July and I'm still waiting for it to be credited.

As far as I was aware it is illegal to take money against a credit card for goods that have not shipped. You can certainly get an authorisation code to proceed with the order but thats it but I could be wrong.

Chargebacks can take up to a year to dispute, but in that time most decent credit card companies will place the charge in limbo - ie you shouldn't have to pay it and it won't accrue interest.

However, if you've already settled your bill down, you may not see it appear as a credit on your account.

The reason for the delay is that each party has up to 40 days to respond to most cycles (chargeback, first presentation, second chargeback, second representation, independent ajudication, ...) and before you know it, you're into months.

However, if the retailer doesn't have a signature on a piece of paper, they're normally stuffed for 100% chargeback liability. It's fun being an on-line merchant...
