just had a call from my bro, the place where he bought his 996SPS (On Yer Bike- Aylesbury) from wont MOT it as it has illegal cans on it...the same cans it had on it when he bought the bike from them are year ago...with a full years MOT!

They've had a change of tester they say and he wont do it now...

I told him to tell them they sold you an un road worthy bike a year ago then and should either provide you with some road legal cans or MOT the bloody thing!

im waiting to here back from him..

Any thoughts?

think it is down to the mot'er now on the cans .if they think there too loud etc etc

the cans have to be kite marked, no kite mark = failure

my mot'er told me its down to the tester, go get it mot'd elsewhere, mine said he would put in ear plugs for my old vtr, lol

Understand you don't need BS or E mark now, must not show 'not for road/highway use' and then it's down to the MoT testers discretion.

I think it's worth talking to the sales manager here rather than anyone in the workshop - might hold a bit more leverage, particularly if you can find other race cans in the showroom.

If the bike was sold without road legal cans fitted or provided as separate items then unless it was expressly sold as for off road use only then this was an offence under the sale of goods act. This has been the case since, I believe, 2001, though I'm willing to be corrected.

That's why dealers want road legal, original cans at least provided when they take your bike in p/ex. And the onus is on them to make sure that the bike is legal when it leaves their showroom.

When I took mine in for MoT 2 years ago I was told that the wording of the law had changed in Jan '05 (I think) and although they could have passed it (with discretion) before then, that after that date they could not... - so had to put a baffle in in the can. ~ £12 IIRC

I'd like to see them baffle my totally standard K7 GSX-R750 when it comes round to MOT, its only done 170 miles but its already as loud as, if not louder than the Scorpion on my ZX6R with the baffle out, and thats louder than my sis's old Fazer 600 with a Blue Flame with the baffle in!!!! (which was failed!!! :eek: )

I was told "louder than standard it will fail"

went elsewhere to a bloke who asked if we had the standard can for the ninja (we do) and said "when it came in here the standard can was on wasn't it?" aware we'd only take it up the road and swap it over again.

Well worth pursuing dealer though. Not good service to annoy a repeat customer like this!

Well, in the end they still wouldnt do it so he told them to forget the service and fitment of some fastners which it was booked in for as well .

Luckily we have a small bike shop nearby who knows what service actually is and did the MOT no probs.

graham22 is correct, as long as it doesn't state not for road use then it is upto the tester. The official line is that the cans should not be excessively noisier than the originals. Given a Duc makes a bit of racket even with standard cans seems ridiculous to me by OYB.
